China’s Outstanding P2P Loans Continue to Increase in March

China reported outstanding P2P loans of Rmb 920 billion ($133.5 billion) at the end of March, according to data from Wangdaizhijia; the March data shows resiliency in the industry despite new requirements for P2P lenders and caps on lending from regulators; P2P platforms have been steadily decreasing following the industry's reform, with approximately 2,281 platforms in March; yields on P2P loans have also been trending lower, with the average yield at 9.4% in March.  Source

Navient Involved in Court Case with the CFPB

Loan servicing company Navient has marketed support for student loan borrowers as part of its customer service strategy however its defense to a court case says the opposite; the company is being sued by the Consumer Financial Protection Bureau (CFPB) for not instituting customer service that matches its customer commitments; the CFPB's main argument is that Navient did not take into account the best interest of borrowers, specifically directing struggling borrowers into payment plans versus capped payment solutions because of the time intensive registration of the latter option; Navient blames a lack of compensation from clients such as the US Education Department for the company's service constraints; the Education Department finds no merit in Navient's defense and the CFPB has data that estimates Navient's service caused borrowers to pay an additional $4 billion in interest charges; Navient has evidence citing a significant number of borrowers in income-repayment plans and has solid arguments including that the federal law does not require servicers to counsel customers on their repayment options.  Source

Consumer demographics are changing with more volatile income, and less interest and access to traditional banking products; LendUp has been working to provide a broader array of solutions for an underserved demographic of consumers and the fintech company has reported a number of successes; it has originated over $1 billion from more than 3.3 million loans; success for the company has come from offering innovative and diverse solutions paired with educational support; examples include graduated credit products that help customers migrate from a $250 emergency loan to a $1,000 installment loan to a $300-$500 low-balance credit card; the firm has integrated initiatives that improve credit availability for on time payments and credit management classes, also reporting $55 million in savings for customers.  Source

Cross River Bank Involved in Court Case with the State of Colorado

Cross River Bank has issued a media alert detailing involvement in a true lender court case with the state of Colorado; the bank has filed a declaratory judgment action against the state of Colorado to protect its rights to extend credit and freely sell loans nationwide; the declaratory judgment action follows a previous court filing in January 2017 by the Colorado Attorney General suing Marlette Funding for issues with its lending process which involves loans made by Cross River Bank and sold to Marlette.  Source

Leading UK Platforms in a Post Brexit World

One of the more controversial items of the past year around the world has been the Brexit vote in the UK, and at LendIt USA 2017 we hosted a panel of leading platforms to discuss what the vote has meant for their companies thus far; consensus opinion throughout the panel was that the campaign leading up to Brexit had a worse effect than the actually vote; most investors these platforms work with wanted Brexit, so the vote of leaving the EU was not a surprise to many platforms; origination volumes have rebounded since the vote and both small business and consumer markets are currently strong in the UK; during the campaign for Brexit a lot of uncertainty was in the market but that uncertainty and bad news was short lived; markets rebounded, the bad news cycles slowed and UK MPL platforms continue to show strength in the post Brexit world.  Source

S&P Global Reports on Q4 2016 MPL Originations

S&P Global Market Intelligence has released data on fourth quarter and 2016 originations for 13 major online lenders; the final quarter of 2016 showed a decrease in loan originations consistent with challenges for the industry in the second half of the year; in the fourth quarter total loan originations were down 15% however loan originations for the year still reported a 15% increase.  Source
