President Trump is set to sign two executive actions on Friday that take aim at reversing the new financial regulations that were put in place as a result of the 2008 financial crisis; the executive actions will give the labor secretary power to rescind the fiduciary rule and ask the Treasury secretary and regulators to come up with a plan to replace Dodd-Frank; the fiduciary rule was set to go into effect in April and was meant to ensure advisors had their client's best interests at heart; Dodd-Frank was passed in 2010 and began implementation in 2012; the law was meant to limit the chance of another financial crisis like we saw in 2008; uncertainty exists with what will end up happening, but signals show that the fiduciary rule will be struck down and Dodd-Frank will be replaced. Tradeshift operates a marketplace for businesses, allowing them to manage supply chain buying and selling; through the partnership with CreditEase, the two firms will develop a financing app that will facilitate lending to Chinese businesses on the Tradeshift platform; according to Tradeshift, the new app will provide a peer-to-peer financing option for hundreds of thousands of China-based exporters. According to Reuters, the American Bankers Association (ABA) is soliciting a marketplace lending partner; the Association acts as a consultant for small banks with less than $250 million in assets and the partnership would help the ABA in its vendor consulting efforts for these small banks; small banks are one subset of the market that has expressed significant interest in online lending and online lending partnerships. New regulations in China tightening controls on P2P lenders will now require P2P lenders to partner with a custodian bank; Chinese banks are not eagerly partnering with the alternative lenders as fraud has been rampant in the industry; less than 5% of the country's 2,534 P2P lenders currently have a partnership with a custodian; custodians will add another layer of authentication for the P2P lending industry since they have high standards for money transfer and safekeeping; currently none of China's big four banks have partnered with P2P lenders for custodian services; smaller banks are getting involved and bank to platform relationships are taking on various forms. A bankruptcy court filing has caused the share price to drop for BofI however FBR is maintaining its outperform rating; BofI is a banking affiliate to online lender Quick Bridge who is the defendant in a court case in which a plaintiff in bankruptcy is seeking to annul its debt from the lender; the plaintiff is claiming the lending relationship violates state laws and that the loan is not valid. Upstart's Dave Girourad talks with TechCrunch about the company's new fundraising round which is adding new capital of $32.5 million; the new capital brings total funding to $85 million and this round's investors included Rakuten, Third Point Ventures, Khosla Ventures and First Round Capital; the fundraising will help the firm launch a new software as a service product called Powered by Upstart, an extension of its proprietary credit underwriting platform which utilizes machine learning and modern data science; Upstart will be releasing the new product at LendIt USA 2017.
